Fair Usage Policy

first:telecom are committed to providing first class customer service, to preserving the integrity of our telecommunications network and avoiding its degradation. If, in our reasonable opinion, we consider it necessary, we may change your services, (including, for example, your transmission speed if you are a broadband service customer) or manage your use of, or access to, our services as we see fit in the circumstances.

We may apply limits to your usage of any service we provide, for various reasons. These may include: if your use of our services is not appropriate or fair, if it affects (or may affect) other users’ enjoyment of the service, or if it is significantly different from the usage that we would expect from a customer. If we think any of these to be true, you should be aware that this could result in us imposing limits of your access to the services; and the following:

Phone customers

  • Charges at our normal rates for calls which we regard as being beyond a 'fair' use of our call service
     
  • The right to suspend ‘free’ call services and revert you to our standard per minute call plan should we deem the usage to be excessive or unfair

Broadband customers

  • Reasonable charges for use of our broadband service outside of any download and/or upload limits on our broadband service. This could include, but is not limited to, any circumstances where you are running an application or program that places excessive bandwidth demands on the broadband service for continued periods. For this reason we have applied a fixed limit or a cap (currently 5GB ‘gigabytes’) to the amount of data that you may download and /or upload. We may, at any time and at our sole discretion, amend this limit, apply charges when you exceed this limit and/or impose a further limit on your usage capacity if it is affecting or may affect other users’ enjoyment of the service.

If the circumstances occur under which we could impose a limit on your use of our services, we may at our sole discretion, suspend or terminate your ability to access the services. We will not do so without your prior notice and will only do so if it is reasonable in all the circumstances. We will always endeavour to act fairly and reasonably when exercising our discretion in relation to the services we provide.
